We reserve the right to suspend or terminate your account without notice or liability, for any reason we deem necessary, especially if you violate these Terms and Conditions.
Upon termination, your access to the service will immediately cease. You can deactivate your account at any time by stopping the use of the service.
Notwithstanding any losses you may incur, the total liability of Swapton and its service providers under these Terms will be limited to the amount you paid for the service or $100 USD if you haven’t made any purchases through the service.
In accordance with applicable law, Swapton and its providers will not be held liable for any special, incidental, indirect, or consequential damages (including but not limited to loss of profits, data, or business disruption, personal injury, or privacy violations), whether or not we were advised of the possibility of such damages.
Certain jurisdictions may not allow the exclusion of incidental or consequential damages, so some of the above limitations may not apply.
The service is provided to you "AS IS," "AS AVAILABLE," including all defects and faults, without any warranty. To the fullest extent permitted by law, Swapton, its affiliates, licensors, and service providers disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Swapton does not guarantee that the service will meet your requirements, operate without interruption, or be free from errors.
These Terms and your use of the service are governed by the laws of Singapore, without regard to its conflict of law provisions. Your use of the platform may also be subject to other local, national, or international laws.
If you have any concerns or disputes regarding the service, you agree to attempt to resolve the issue informally by contacting Swapton.
For European Union (EU) Users: If you are a consumer in the European Union, you benefit from any mandatory provisions of the law in your country of residence.
You affirm that (i) you are not in a country that is under a U.S. government embargo, and (ii) you are not listed in any U.S. government restricted party list.
If any provision of these Terms is found to be unenforceable, the provision will be amended to achieve its original intent to the maximum extent possible, and the remaining provisions will remain in full force.
The failure to assert a right or enforce a duty under these Terms does not limit a party's ability to assert such right or enforce such duty in the future.
